Negotiation and Dispute Resolution — Frequently Asked Questions

Do I have to sue to enforce a Georgia contract?

No. Most Georgia contract disputes settle without litigation. A demand letter, followed by negotiation, resolves the majority of cases we see.

How does Georgia arbitration work?

Under an arbitration clause, the dispute is heard by one or three arbitrators rather than a judge or jury. Discovery is limited, the process is faster, and the award is enforceable in Georgia court. The tradeoff is limited appeal rights.

Can I recover attorneys' fees in a Georgia lawsuit?

Sometimes. Georgia's fee-shifting statutes and contract fee-shifting provisions cover certain cases. We advise on likely fee recovery as part of the litigation strategy.
